	Binding my account with the present computer Terms of Service Important Notice: It is hereby suggested by e-Software that users earnestly read this Terms of Service. --- Users shall earnestly read terms and conditions stated in the Terms of Service (hereinafter referred to as Agreement) (as for minors, they shall be accompanied by legal guardians). Such terms and conditions include exemption clauses aiming to remit or restrict responsibilities of e-Software and limits to users' right.You may choose to accept or reject this Agreement.You shall not be entitled to download, install or use this software and relevant services unless you accept this Agreement.In case that you have installed and applied the software, it is regarded that your have accepted this Agreement and that you agree to accept bindings from this Agreement. This Agreement is concluded between Beijing e-Software Computer Technology Co., Ltd. (hereinafter referred to as e-Software) and its operation copartners (hereinafter referred to as Copartner) regarding the download, install, copy and application of DriverEngine.com (hereinafter referred to as Software) by users.This Agreement states rights and obligations concerning Software license use and relevant issues between e-Software and you."User" or "you" refer to an individual or entity that has obtained Software authorization and/or software products by means provided by e-Software. 1 Statement on Intellectual Property 1.1 This Software is developed by e-Software.All intellectual properties, like copyright, of Software and all information of the software, including but not limited to the literal statements and their combination, icon, images, charts, color, interface design, page frame, relevant data, printing materials or e-documents, shall be under the protection of the Law of Copyright, International Copyright Treaties as well as other intellectual property laws. 2 Authorization Scope of Software: 2.1 This Software can be installed, use, displayed and operated on a single computer, terminal set, workstation or other digital electronics (hereinafter refer to as Computer jointly). 2.2 Rights Reserved: all rights that have no express authorization shall be reserved by e-Software. In case that users want to execute other rights, written approvals from e-Software shall be obtained. 2.3 Except regulations clearly stated in this Agreement, no service terms and conditions on visiting other services provided by e-Software via this Software are established. As for such services, there may be specific service terms are available for normalization and consequently, users shall make separately understanding and confirmation when using relevant services.It will be regarded that the user has accepted all terms and conditions when using the service. 3 Notice to Customer 3.1 Users shall apply this Software according to this Agreement with the precondition of abiding by the law and this Agreement.Users shall have no right to carry out the following activities, including but not limited to: 3.1.1 Deleting information and content concerning copyright on this Software and other copies; 3.1.2 Reversely engineering, compiling and editing this Software; 3.1.3 Regarding relevant information of this Software, prior to the written approval from e-Software, users shall not perform the following activities, including but not limited to: use, duplicating, modifying, linking, reproducing, compiling, publishing, issuing, establishing mirror site, developing spin-off products/works/services via this Software, etc. 3.2 Users shall observe relevant national laws and policies, protect the national interest and safeguard the national security as well as abide by this Agreement during the use of this Agreement. All responsibilities resulted from the use of this Software under the violation of laws or this Agreement shall be assumed by the user and e-Software and its Copartner shall be exempt all duties thereof. In case that losses have been caused to e-Software and its Copartner, e-Software and its Copartner have the right for indemnity from the user and are also entitled to immediately terminate services to this user, keep related records and reserve the right to assist the juridical authorities for investigations on legal responsibilities. 3.3 Just like most internet software, this Software may be troubled with security problems. For instance, the regular service of this software will be influenced due to threat on the security of user computer information and data from virus like Trojan that is inserted in other download software. It is hereby recommended that information security and user data protection be strengthened to avoid loss and harassment. 3.4 Any other software derived from this software but developed and issued by e-Software or without the authorization of e-Software shall be illegal. If such software is downloaded and applied, unexpected risks may happen. e-Software shall be exempt from any responsibilities to legal responsibilities and disputes thereof. It is hereby advised that users not download, install or use such software. 3.5 e-Software will adopt rational measures to protection user data. Unless required by the government or consented by users, e-Software won't disclose such data to any third party except its Copartner. Exceptions shall be made when users have reached other agreements regarding user data disclosure with e-Software and its Copartner. In this case, users shall bear all possible risks thereof and e-Software shall be free of any responsibility. 3.5.1 Generally speaking, user data may be used by e-Software due to the following reasons: (1) performing software verification service; (2) performing hardware fault detection service; (3) software upgrade service; (4) enhancing use security and providing customer support; (5) in case that users require specific functions of DriverEngine.com and that users request e-Software or its Copartner to provide specific services, e-Software or its Copartner shall provide the user data to concerned third party. 3.5.2 Means Consented by Users: (1) accepting this Protocol and service terms issued by e-Software; (2) oral or written expressions made by users by means of Email, telephone, fax and real-time communication; (3) users have no objections to implied consent terms in the Protocol or Service Statement; (4) other means ratified by e-Software and users. 3.6 Software Substitution, Modification and Upgrade: e-Software shall reserve all rights to provide the substitution, modification and upgrade versions of this Software and also reserve all rights to collect charges for such substitution, modification or upgrade. 3.10 e-Software and/or its Copartner will provide users with various internet value-added services, free or charged, according to the development of market and technology. e-Software and/or its Copartner shall reserve rights to collect charges and change charging standards for relevant value-added services. In case that some services free of charge are altered into paid services, e-Software and/or its Copartner will notify users in due form. Then, users can decide whether to accept such paid services or not and shall ensure that when using these paid services, they shall pay all expenses according to relevant charging regulations from e-Software and/or its Copartner. In case that users refuse to pay or fail to pay on time, e-Software and/or its Copartner are/is entitled to terminate such services and recover loss and indemnity thereof ipso jure. 4 Legal Responsibilities and Exemption 4.1 It is hereby particularly noticed that, to guarantee its business development and regulation decision-making power, e-Software is entitled modify or interrupt the software authorization voluntarily at any moment without noticing users. If necessary, modifications or interruptions will be published on the e-Software website as an Announcement. 4.2 In case that users have violated this Protocol or relevant service terms, in light of the nature of user behaviors, e-Software is entitled to take such measures, including but not limited to, as interrupting use permit, terminating services, restricting adoption and resorting to the court. Meanwhile, as required by judicial departments, e-Software will assist their inquiry. 4.3 Users shall bear all risks resulting from the adoption of this Software. e-Software and its Copartner will make no guarantee, expressed or implied or statutory, for this Software. Such guarantee shall include but not limited to the marketability, applicability, virus-free, negligence-free or technical-fault free, ownership, quiet enjoyment, express or implied guarantee and conditions for infringement-free. Under any occasions, any direct, indirect, accidental, particular or succeeding damages and risks resulted from the use or out-of-use of this Software shall bring no duty to e-Software and its Copartner. 4.4 The use of this Software is involved in the internet services, so the Software is probably influenced by unstable factors. Consequently, such risks as the service interruption or services failing to meet user requirements due to force majeure, computer virus, hacker attach, system instability, user location, user shutdown or other problems concerning network, technology and communication lines shall be understood and undertaken by users. Accordingly, for any side effects thereof on users, e-Software and its Copartner shall be exempt from any duties. 4.5 During the application of this Software, risks of receiving threatening, slandering, disgusting or illegal information in anonymity or personation may happen, so we hereby inform that the user shall assume the said risks. e-Software and its Copartner will be exempt from responsibilities on the authenticity, applicability and validity of any relevant information. 4.6 In case that users make contacts with a third part via this Software and that users suffer from psychological and physiologic injuries and economic losses resulted from or possibly resulted from mislead or deception from the third party, the offence shall bear all responsibilities. e-Software and its Copartner shall be foreign to such cases. 4.7 In case that services can't be provided due to force majeure, like technical failure, e-Software and its Copartner hereby promise to assist entities concerned immediately to make repair. But, for economic losses thereof on users, e-Software and its Copartner shall be exempt from any responsibilities. 4.8 In case that users make contacts with a third part via this Software and that users suffer from psychological and physiologic injuries and economic losses resulted from or possibly resulted from mislead or deception from the third party, the offence shall bear all responsibilities. e-Software and its Copartner shall be foreign to such cases. 5 Misc 5.1 In case that in this Protocol, any term, partially or wholly, goes invalid, the validity of other terms shall be unaffected. 5.2 The Chinese laws shall be applicable to the interpretation, effectiveness and dispute solution of this Protocol. In the event that any disputes or dissensions happen between users and e-Software, both parties shall resort to friendly negotiation. If the negotiation fails, users hereby agree that such disputes or dissensions shall be reported to the court where e-Software is located. e-Software shall reserve the copyright and all rights to interpret. e-Software
